What is the purpose of Cbp 4457?
There is no legal duty for individuals to check in if they do not intend to travel, but it appears that those who do so might be stopped for random drug testing. CBP 4457 was first released in early 2016 and is supposed to help CBP agents “make arrests or provide information to the Immigration and Customs Enforcement (ICE) regarding persons subject to civil immigration enforcement action.” It is also supposed to help CBP agents “ensure that individuals do not violate immigration laws or enter the U.S. while under investigation or custody for a non-criminal offense,” and that it is “an automated system designed to ensure that an individual is a U.S. resident for immigration purposes.” Although some have criticized the use of these automated systems by the CBP to screen immigrants, Congress directed CBP to work to “establish and enforce automated systems for detecting illegal aliens in the United States.” In 2011, the Department of Homeland Security's Office of the Inspector General reviewed the CBP 4457 program. The report, written by two Inspectors General, found many false positive tests, and that the system may not have been well managed. Of CBP 4457's 31,000 positive-screening results, only 15% turned out to be accurate, the report found. There were also many examples of screening and arresting people who did not have the correct documentation. While these positives represent a small portion of the screening system of a population of 11 million undocumented immigrants, they represent a small portion of the 11 million undocumented immigrants who are checked and detained.
